As Senator, would you step in to make a difference if you knew of a case where a judge has completely denied the defendant the right to defend himself? Such a case is currently being heard in a Maryland courtroom. An 18 year highly decorated (Bronze Star recipient) career lt. Col. Terry Lakin who served several tours in Bosnia and Afghanistan has tried through military channels to determine if orders coming down the chain of command are lawful. When all military channels were exhausted he bravely and openly INVITED his own Courts Martial as his only recourse to get an answer for himself and for all members of the military facing the same doubts. A simple request for discovery would quickly answer the question that he and many of his fellow soldiers are asking. He has the backing of three Generals, Maj General Paul Vallely (Ret), General Curry, and 3 star General McInvery (ret) who submitted an affidavit to the court urging discovery as a grave matter of national security. Judge Lind refused all discovery, and all witness testimony as to any of the items requested in discovery. Neither can he bring up any of his doubts, reasons or motivations as a defense. This leaves him with absolutely no defense whatsoever. He had his second hearing today and his lawyers were pleading with the judge to grant him a defense but was refused again by Judge Lind. He is being denied the Constitutional promise of due process. So I ask, would you step in and lend your support for this brave soldier who now faces 4 years at hard labor because he dares to ask an unpopular question? Thank you for your consideration in this matter. This question is being asked of each of the candidates for Senator.
